The conflict between actor, Kang Ji Hwan and his former agency has been resolved amicably.

An official of Kang Ji Hwan's agency told My Daily last Oct. 15, 2013 that the sanction imposed by the ethics committee of the Korea Entertainment Management Association (KEMA) has been lifted. This was the result of the dispute resolution between Kang Ji Hwan and his former agency, SPlus.

The official said that the lifting of the ban would lead to Kang Ji Hwan having more activities from now on. "I'm looking forward to it", he said.

In October of last year, Kang Ji Hwan, had a conflict with his former agency, Splus regarding his contract and other issues surrounding the conflict. Splus filed an injunction to stop Kang Ji Hwan's activities.

KANG JI HWAN WINS COURT CASE AGAINST SPLUS
translated by: KJH Philippine Operator
10/20/13

The controversial case of actor Kang Ji Hwan (37) against SPLUS has been settled after more than a year of coming in and out of the courtroom.

The Seoul Central District Court has dismissed the case filed by SPLUS against Kang Ji Hwan regarding the validity of his exclusive contract with their agency. The court ruled that the plaintiff, Splus should compensate 5 million won to Kang Ji Hwan.

In January of 2010, Kang Ji Hwan entered into an exclusive contract with SPLUS. At that time, his former agency, Jambo Entertainment claimed that Kang Ji Hwan's contract with them has not been completed yet and as a result, he had not been active in about eight months in response to the recommendation from the Korean Entertainment Management Association.

From October to December of 2012, Kang Ji Hwan avoided contact with SPLUS and delegated a law firm to manage his affairs.

SPLUS side filed charges against Kang Ji Hwan for "not substantially performing arts activities for a total of 10 months. The contract must automatically be extended to verify this."

However, the Court dismissed the claims of SPLUS by stating that "exclusive contract as long as the real entertainment activities do not automatically extend the term of the contract" and "part of the grounds that artists are responsible for a certain period of inactivity, if not automatically extend the term of the contract and that the practice of is not enough to acknowledge that, "he decided.

SPlus raised the issue that since October, Kang Ji Hwan has not consulted their office and went into negotiations with SBS for the drama, "Incarnation of Money".

The Court determined that they do not have sufficient evidence to make an objective evaluation that Kang Ji Hwan unilaterally violated the exclusive contract with SPlus.

Rather, the Court ruled that SPLUS should compensate Kang Ji Hwan with 5 million won for falsely stating in their statements which were distributed to the journalists last December 2012 that Kang Ji Hwan assaulted the manager of SPlus.

The Court pointed out that the false facts which were released against Kang Ji Hwan were insane acts which were unethical in the entertainment industry officials and employees of the firm. The Court held that the malicious articles were worthy enough of defamation that would mar the social reputation of Kang Ji Hwan.

Kang Ji Hwan Wins the Legal Battle Against His Old Agency
jun2yng October 20, 2013

The Seoul Central District Court recently dismissed the lawsuit verifying the validity of a contract filed by actor Kang Ji Hwan’s former agency, SPLUS Entertainment. In addition, Kang Ji Hwan’s lawsuit against SPLUS was successful and he will receive 5,000,000 won (roughly $4715) in damages.

In January of 2010, SPLUS signed an exclusive management contract with Kang Ji Hwan. Because this was done before the termination of his contract with Jambo Entertainment, he had to suspend his entertainment activities for roughly eight months at the advice of the Korean Entertainment Management Association.

From October to December of last year, Kang Ji Hwan avoided contact with SPLUS and entrusted his management to his attorney. SPLUS claimed that “Because, at his own fault, he [Kang Ji Hwan] couldn’t participate in entertainment activities for ten months, it was necessary to automatically extend the length of his contract for that same length of time,” and filed a lawsuit to confirm this. Upon review of the contents of the contract and finding no word about automatic extension of the contract, the lawsuit was dismissed.

Last December, SPLUS distributed to internet news reporters false information about Kang Ji Hwan and him ranting about his managers. Kang Ji Hwan then sued the agency for defamation. SPLUS was recently ordered to compensate Kang Ji Hwan for damages in the amount of 5,000,000 won, on the grounds that the information released was enough to negatively affect his reputation, including false information about unreasonable and immoral actions by Kang Ji Hwan and his lack of qualifications as a public figure.
