It's so good to see Heenim (1 week to go! Hope he tweets asap ) and Siwon on the MV teaser even if they're not in the group dance... I must say, A-Cha is totally different from their usual follow-up songs. I was expecting cute and sweet. I'm not sure about the MV though. It's very reminiscent of all their previous MVs... But! I'm happy to see our boys again. They were so dorky in the backstage interview

All I can say is that the I'm excited for the MV... MuBank performance was a bit 'struggling' for the boys esp. Sungmin and Donghae were trying to cover for the missing flower boys Heenim and Siwon... But then again 'm definitely excited for the Inkigayo performance. After all. Inki always gives the best stages for the boys... So when will SM release the MV now??? Today? On Monday??? Hmmm.... won't it be a little too late then??

And SS4 will happen soon... if Teukie's tweeting about it, maybe the preparations are all set!!

110925 Updates to Han Geng’s lawsuit with SME

Earlier this was reported in Korean news: “Slave Contract Nullified” Super Junior’s Hankyung Appeal Withdrawn (link to an English translation by soluna413 @ tumblr)

However, since it seems like a lot of people have trouble understanding the legal terminology used, our admin Windchime wrote up this summary based on a Chinese translation to explain everything:

On December 21st 2010 the Courts declared Han Geng the winner of his case against SM, at that time SM declared that “they can not accept the decision” and filed an appeal attempting to get the courts to overturn the decision roughly 2 weeks (?) later. I don’t really remember the exact date. No major news sources really reported about it, so maybe a lot of ppl never knew that SME appealed.

So technically Han Geng hasn’t exactly won the case yet due to SME appealing. However, since he has the court decision made on December 21st to back him up, his contract with SME is considered invalid unless SME wins the appeal. However, his contract would still exist unless SME loses or drops the appeal. (If anyone still searches Han Geng on naver, they will see that he is still listed as under SME, this is because, due to SME appealing the court’s first decision, Han Geng’s contract with SME still exist, he just is not bound by it until further court notice. Naver has stated after an inquiry that when Han Geng officially wins the appeal, they will remove SME as his company.)

This new thing that Han Geng just filed is requesting the courts to drop SME’s appeal since it’s not going anywhere. Meaning it’s pretty much asking the court to declare SME’s appeal invalid. If Han Geng’s petition is granted, then SME will be forced to drop the case, and the first court decision, which is Han Geng winning the case will remain. Meaning that if he wins this case he would be officially free of SME.

This new thing Han Geng is filing is pretty much him say to the courts that he’s doesn’t want to waste time with SME anymore and he thinks SME’s appeal is ridiculous so he can officially be free.

@snapliok if there was an official announcement from SMent... then it would really confuse the people a lot more... Because the first one sounds more logical than the second. One, if Hankyung really filed a motion to withdraw case, it would not just make him look bad; it would make him look stupid (please no offense intended) because what's the purpose of him trying to go all out and win the initial case if he'd just drop it when it's already ruled in his favor? I mean it would be a bit logical IF he lost it, but he didn't; HE EVEN WON. So really the news is getting crazy, but I do appreciate your quick reply... Thankies!! Until we really see an announcement at SMent's site, I guess I wouldn't believe an ounce of the two news to be fair... Thanks again @snapliok!!!

^yea it's really confusing too. especially the part where SM released their statement on the issue. They're now saying that since Hankyung dropped his case, therefore he acknowledged the fact that he is still under SM and all his activities in China are now controlled by SM???????

He already won the case, SM just appealed the case early this year since they wanted Hankyung to pay for all the damages and unfinished contracts he currently has with SM.........

sigh. hopefully in time, we would be able to understand this.

Hopefully a lawyer ELF or an ELF who's studying law and social studies can explain this further? =)
