Easy to exchange ipods at the apple store?

Long story short: I'm going to get a used 60 gb video ipod that is still under warranty.

But I want to bring it into the store to get a brand new one. I already know that this ipod isn't functioning perfectly. Basically, it just skips over songs when playing...

With that in mind, will the Apple store let me get a new one under those circumstances?

^Yes, they check by serial number. I think you can even check your warranty status on the apple site under support for information.
